Reasons for a Federal Assessment

On June 15, 2004, it was determined that an environmental assessment was required in relation to the project because the Canadian Environmental Assessment Agency considered taking action in relation to subsection 25(2) of the Dominion Water Power Regulations.

Project Description (as posted in the Notice of Commencement)

The Honourable David Anderson, Minister of the Environment, today announced the referral of the Bennett High-Temperature Thermal Oxidizer Project, located in Belledune, New Brunswick to a federal review panel. The review panel will examine the project's potential transboundary environmental effects in the province of Quebec, on federal lands and in the waters of the Baie des Chaleurs.

In accordance with the Canadian Environmental Assessment Act, Minister Anderson announced on May 21 that he was giving notice to the proponent, to the governments of New Brunswick and Quebec, and to petitioners of his intention to refer the project to a review panel.

Final Decision

The environmental assessment was terminated on September 16, 2005 because the Court had ruled that the Canadian Environmental Assessment Act did not apply to this project.
