  • Good afternoon Avril. In preparation for our meeting tomorrow we have a number of questions we would like to discuss. For the purpose of the federal and provincial EAs our questions are issues and concerns.We require a response to our questions in writing.   Noront Studies, ShapeFiles and Lidar. In your letter of January 17, 2020, you report that: "Noront has agreed in principle to share all documents with Neskantaga that relate to the MFFN community access road EA. We would like to discuss and understand which reports you require and we can then get those reports to you from Noront.” The first studies we require are any and all archeological studies[likely the Cliffs stage 1 archaeological assessment of the proposed routes] that Noront holds. MFFN and Noront can communicate directly with Neskantaga’s cultural heritage advisor Dr. Scott Hamilton on the transfer of the reports. While LL58 has made all efforts to be engaged and informed on these projects (including two meetings with the IAAC and hosting a community engagement session with the assistance of Four Rivers (our technical services group)), our Lands & Resource department does not have dedicated staff fluent with Impact Assessment (IA) legislation and processes (especially in light of the new and evolving IA Act). Additional timeline and capacity restrictions have been encountered due to the holiday season (two-week office closure), community elections (last week), lack of in-community engagement to-date from the Project Proponents and limited funding to support community capacity in IAs. Furthermore, as detailed in our Engagement & Accommodation Protocol (provided to the IAAC on January 8, 2020), appropriate community consultation and engagement requires the time and resources to engage all members of our community (from Elders to youth) in this process. Through the assessment and evaluation of these proposed road projects, EFN will participate and contribute to the testing of how and if such projects can be reasonably expected to improve life within the region and our community. This most fundamental question is often muddled through complex assessment processes that test possible impacts, mitigation approaches, and residual effects through a vast suite of indicators and criteria that are not entirely reflective of community values or context. Therefore, many recent EA processes that EFN has participated in have failed to appropriately capture and/or respond to impacts, including cumulative effects, of projects and their real effects on community life.   • Thank you for the opportunity to comment on the Impact Assessment of the Webequie Supply Road Project and Impact Assessment of the Marten Falls Community Access Road Project.  The placement and intent of both these projects are predicated on an inevitable next phase or end-game that results in construction of a north-south or east-west all-weather access road to one or more potential mine locations within the Ring of Fire. Neither of these two projects can be adequately assessed independent of that context.  The true and consequential impacts will be the cumulative effects of the longer-term full road network and associated construction, maintenance, and subsequent use on a wide range of ecosystem functions.  A reqional environmental assessment is essential to anticipating long term effects at an adequate scale to protect economic, social and environmental interests. The draft Tailored Environmental Assessment Guidelines for both projects require the description of location to focus on aspects of the project and its setting that are important in order to understand the potential environmental, health, social and economic effects and impacts of the project. As these two projects are proposed to be assessed independently as stand-alone projects there is great risk that the nature and scope of impacts may be inadequately identified or mitigated.  There is little indication that the environmental significance and value of the geographical setting in which the project will take place and the surrounding area is being considered at an appropriate scale.   • Good morning. I would like to extend my opinion of support for the Martin Falls Community Access Road. This road will allow the residents of the community benefits that many people in urban areas take for granted. It is a holistic solution to the region and will facilitate positive changes. With climate change being a real thing, a winter road is not sustainable, nor is air freight. Now for the urban people, look at a mattress for your home. You are at the store with your family looking at furniture for your home, (possible 2 people or more). To get to a town or city, you took a seasonal road or airplane. That costs alone several hundreds if not thousands of dollars itself. This is for shopping or appointments, not a vacation to a warm place for a week.  Now look at the good that you have purchased, you now have limited space on the plane or vehicle to bring these things back to the community. Look at the cost to ship that mattress, several hundred dollars more on top of the other expenses just to go to an urban area. I spoke of a holistic solution to the region… A road will allow the residence of Martin Falls First Nation to go as they please being connected to the Hwy system. It will allow for building materials and goods to flow more environmentally and economically sustainable to facilitate housing, infrastructure, and economic projects. It will remove the sense of isolation that residents may feel that can’t afford to travel buy airplane for their families. Now on the economics of the road project.   • 1 MLi3 Inc. Commentary on Marten Falls Community Access Road Draft EIA Guidelines 1. Overview The draft Guidelines are a good attempt to build a defensible form of EIA guidance to the proponent. They are very comprehensive. Notwithstanding the title, however, these “Tailored Guidelines” need substantial ‘tailoring’ to help the proponent create a clear, practical and defensible scope of assessment for the project. The draft Guidelines reflect a very significant effort to display consideration of Indigenous culture, value systems and sensitivities. That said, the guidance’s reliance on listing of subject matters deserving assessment attention is so discretized as to lose sight of many of the holistic, synoptic value systems that Indigenous communities repeatedly say they want applied in assessments. Further, they ignore other factors affecting assessment processes, especially technological innovation, uncertainty about best practices in planning for community engagement and calls for greater rigour in cost-benefit analysis. As well, there is a somewhat dated quality to the draft. Most especially, it doesn’t reflect any sense of the real urgency of many of the environmental-protection needs within the Boreal. My comments arise from 3+ decades of designing, managing, interpreting the results from, and documenting EIA processes. I could have written on almost every single itemized subject matter in the draft Guidelines. I will confine this communication to only 4 matters.   • MFFN Access Road EA Process & Webequie First Nation Supply Road December 13, 2019 Fort Albany First Nation has a mixed economy (Sustenance –harvesting/trapping/hunting/fishing, local entrepreneurship, resource based economic practice including small scale forestry, some professional work, i.e., health services, education, administration, retail, etc.) There are currently high unemployment rates and lower high school graduation rates. Training in resources related fields, particularly within the traditional homelands of FAFN should be the focus for negotiations, lobbying, and advocacy activities by Chief and Council, Mushkegowuk Council, NAN, COO, and AFN. Fort Albany First Nation(FAFN) has relied on the lands, waters, and related resources on their homelands of Treaty #9 of 1905, as the primary economic driver long before 1492. Today, many of the natural resources are rapidly depleting due to Climate Change, pollution, globalization, natural and man-made disasters (ie, Victor Mine Invasive species introduction, Attawapiskat River mercury effects/affects, related environmental disturbances, industrial-age introduction and/or impacts). However, there are opportunities for the Peetabeck Inninowuk (FAFN) to encourage new and emerging economic and business developments to create a sustainable community without compromising our Inninowuk culture, heritage, or Inninowuk Aski (homelands within Treaty #9 of 1905). The challenge for the Peetabeck Inninowuk community is to identify these opportunities and develop viable mushkeg focused economies, entrepreneurial initiatives, and associated capacity.
