Decision

Fisheries and Oceans Canada and Natural Resources Canada have taken the following course of action on July 24, 2014 relating to the comprehensive study of the Kitsault Mine Project. Fisheries and Oceans Canada and Natural Resources Canada may exercise any power or perform any duty or function with respect to the project because, after taking into consideration the comprehensive study report and its addendum and taking into account the implementation of appropriate mitigation measures, the authorities are of the opinion that the project is not likely to cause significant environmental effects.

Implementation of mitigation measures is required for the project to address:

  • Amphibians and/or their habitat
  • Benthic communities
  • Birds and/or their habitat
  • Fauna at risk (as defined under the Species at Risk Act)
  • Fish and/or their habitat
  • Wildlife and/or their habitat
  • Current use of land and resources for traditional purposes by Aboriginal persons
  • Effects on residents of Nisga'a Lands, Nisga'a Lands and Nisga'a interests
  • Human health
  • Physical and/or cultural heritage
  • Structure, site or thing of historic, archaeological, paleontological or architectural significance
  • Water quality
  • Water quantity

A follow-up program to verify the accuracy of the environmental assessment and/or determine the effectiveness of any measures taken to mitigate the adverse environmental effects is required for this project.
