Notice of Determination

 

Cape Scott, BC – March 25, 2024 – Fisheries and Oceans Canada has decided that the project Cape Scott Fuel Tank replacement is not likely to cause significant adverse environmental effects.

 

In making this determination, Fisheries and Oceans Canada considered the following factors and mitigation measures:

 

Factors

 

? Impacts on rights of Indigenous peoples;

 

? Indigenous knowledge;

 

? Community knowledge;

 

? Comments received from the public; and

 

? Technically and economically feasible mitigation measures.

 

Mitigation Measures

 

? Activities should be completed in such a way as to limit stress and disturbance to resident

 

flora and fauna (aquatic or terrestrial).

 

? Construction footprints should be limited to the area necessary to safely complete the

 

works.

 

? Fuel tanks will be fully emptied of liquid and/or sludge and purged of any vapours before

 

removal and extraction on site.

 

? Spill containments must be readily identifiable, in good working order, and located on

 

barges, vessels, and at the project site.

 

Fisheries and Oceans Canada is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects, on areas of federal jurisdiction. Environmental effects that are within provincial jurisdiction would be addressed through provincial regulations.

 

Therefore, Fisheries and Oceans Canada may exercise any power, perform any duty or function, or provide financial assistance to enable the project.
