Notice of Determination 

District of North Vancouver, B.C. – February 28, 2024 – The Vancouver Fraser Port Authority has determined that the proposed new dock installation located at 2136 Lockehaven Rd, North Vancouver is not likely to cause significant adverse environmental effects.

The determination was based on a consideration of the following factors:

• Impacts on rights of Indigenous peoples
• Indigenous knowledge
• Community knowledge
• Comments received from the public
• Technically and economically feasible mitigation measures

Best efforts were made to consult with Musqueam Indian Band, S'ólh Téméxw Stewardship Alliance, Squamish Nation, and Tsleil-Waututh Nation. Comments around the following topics were received:

• Cumulative effects of recreational docks
• Spill response and spill kit requirements

The project was posted to the Canadian Impact Assessment Registry on December 6, 2023 for public comment. No comments were received.

The District of North Vancouver was consulted on December 6, 2023. The following comments were received:

• The dock crosses a District of North Vancouver-owned lot. Property use may require a District of North Vancouver license agreement
• The District of North Vancouver environment department will require an aquatic area permit
• An arborist report will be required to assess tree impacts, and a tree permit may also be required if any tree work is required
• A District of North Vancouver building permit may be required

Owners of neighboring properties, 2128 Lockehaven Road, 4636 Eastridge Road, and 1422 Pemberton Avenue were sent a notification letter on November 26, 2023. No comments were received.

Mitigation measures and/or permit conditions taken into account in making the determination include:

• The works will not deposit a deleterious substance in water inhabited by fish, or affect fish or fish habitat in a manner contrary to the Fisheries Act
• There will be no in-water works during the fisheries-sensitive period from March 1 to June 15, inclusive
• Piles will be installed using vibratory. Other pile installation methods are not allowed without approval from the Vancouver Fraser Port Authority
• Barges and other support vessels will be prevented from grounding on the foreshore or otherwise disturb the foreshore
• All construction debris and waste materials will be collected in the immediate working area and disposed of at an appropriately licensed facility

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.
