Reasons for a Federal Assessment

On March 30, 2011, it was determined that an environmental assessment was required in relation to the project because Fisheries and Oceans Canada considered taking action in relation to subsection 35(2) of the Fisheries Act and Transport Canada considered taking action in relation to section 5 of the Navigable Waters Protection Act.

Project Description (as posted in the Notice of Commencement)

The Canadian National Railway Company (the proponent) is proposing to conduct bank stabilization works on the McLeod River located 45 km southeast of Hinton. The proposed works include the installation of rock riprap along the bank, construction of 3 rock groynes and 4 bendway weirs, excavation of 6 groundwater channels, installation of large woody debris structures along the groynes and weirs and construction of a rock riffle on a groundwater fed tributary.

The scope of the project includes all physical activities associated with the riprap and large woody debris installation, construction of rock groynes, weirs and riffle and excavation of groundwater channels.

Final Decision

On July 6, 2012, the new Canadian Environmental Assessment Act, 2012 came into force which replaced the former Canadian Environmental Assessment Act. As a result, there is no longer a requirement to complete the environmental assessment of this project.
