  • Good morning,   My apologies for the delay. We were working with our legal team, and I see I have missed the deadline by a day (yesterday). I am hoping you will still consider our comments regarding the Flipi Gas-Fired Generation Project. I have attached a commitment letter that has been signed by our legal council and the legal council of TransAlta for the AUC process regarding the project. For this type of project, Clearwater County will require a redistricting of the property to the appropriate land use district for the proposed use, and then an application for a development permit for that use once that property is appropriately zoned. That application for development permit will require the operator meet setbacks identified in the land use bylaw, and will request items as per the commitment letter, such as fencing/screening and road use agreements. They have been notified of this process previously.   Thank you for your time and consideration.

The Municipality and TransAlta have been engaged in discussions relating to this Project. As a consequence, TransAlta has agreed to the following commitments, which are binding on TransAlta whether or not the commitment is made a condition of approval.1 Legal counsel for TransAlta, Gavin Fitch, has signed off on the commitments (see below). The commitments have been drafted to allow the AUC to make specific directions on certain issues, while ensuring the Municipality still retains jurisdiction, as prescribed. This addresses any concerns about the impact of section 619 of the Municipal Government Act. As well, the Municipality’s preference is that the AUC entirely defers the issue of hauling routes and road use to the Municipality despite it being an issue raised by landowners in these proceedings.   • January 27th, 2026 Impact Assessment Agency of Canada RE: Comment on the Summary of an Initial Project Description for the TransAlta Flipi Gas-Fired Generation Project Project Title/Name: Flipi Gas-Fired Generation Project Proponent: TransAlta Corporation Due: January 27th, 2026 Summary The Flipi Gas-Fired Generation Project is planned to occur in a region known to be of significant importance for Métis traditional land uses, and any disturbance with impacts on Crown land, wildlife, water bodies, and habitat are a concern for the Otipemisiwak Métis Government. While direct impacts from the main project footprint appear to be limited, given that it is on previously disturbed/cultivated private lands, we have concerns that construction activities as well as operation of the proposed project may be disruptive to previously documented hunting and trapping activities in the area. Additionally, we have concerns that many ancillary infrastructure works – some of which may have direct impacts on Crown land, water, and wildlife – are not detailed in the Initial Project Document and thus difficult to assess.   • Otipemisiwak Métis Government – Jasper House Métis District Council 111-50 Street, Edson Alberta T7E 1T7 1 Comments on Flipi Gas-Fired Generation Project Initial Project Description Introduction: Jasper House Métis District Council (or Otipemisiwak Métis Government, District 7) is a rights- holding Métis community in the North Saskatchewan River Territory. As outlined in the Otipemisiwak Métis Government Constitution (Chapter 15),1 our District Council is a duly elected council representing the rights of over 1000 self-determining Citizens exercising our Aboriginal rights as enshrined under section 35 of the 1982 Constitution Act.2 We, the District Council, are authorized to conduct consultation and accommodation with the Crown, industry proponents and other vested stakeholders on behalf of our Citizens regarding their rights. The proposed Flipi Gas-Fired Generation Project (the Project) is a 460-megawatt (MW) gas-fired generation project located near the Town of Rimbey and less than 3.5 kms from Crown Land, overlapping with Métis Harvest Area D, as outlined in the 2018 Métis Harvesting in Alberta Policy.3 The policy recognizes the cultural importance of access to subsistence and harvesting practices, including hunting, fishing, and trapping.   • 1 Kikino Métis Settlement Comments on Flipi Gas-Fired Generation Project IPD Submission for Flipi Gas-Fired Generation Project Initial Project Description January 23, 2026 Introduction Kikino Métis Settlement is in northeastern Alberta, approximately 128 kilometers west of Cold Lake. It is one of eight Métis settlements incorporated under Alberta legislation. Over 1,100 members live on Settlement today. The name Kikino comes from a Cree name meaning “Our home.” Kikino Métis Settlement holds recognized and constitutionally protected Indigenous rights, including the right to harvest animals and plants for subsistence purposes. The proposed Project (Flipi Gas-Fired Generation Project) is located within Métis Harvesting Areas D, an area designated for harvesting purposes under Alberta’s Métis Harvesting in Alberta Policy (2018).1 Kikino Métis Settlement is also located within Métis Harvesting Area D, and many of our members have historically, and continue today, to use the lands around the Project to exercise their constitutionally protected right to harvest for subsistence purposes. The significance of the harvestable areas found in Métis Harvesting Area D, and in particular of the areas in the western portion, have increased over time. The development of agriculture, oil and gas, forestry, and other sources of anthropogenic disturbance and taking up of lands on and around the Settlement have forced members to travel greater distances to exercise their constitutionally held Indigenous rights.
