  • Hi Colter, My apologies for the delay in responding to this request and I thank you for the opportunity to provide some input for your consideration on a Regional Assessment for the Western Energy Corridor. Fisheries and Oceans Canada (DFO) has a mandate to manage and minimize impacts to fish and fish habitat, including aquatic Species at Risk, and thus would be our interest in any potential Western Energy Corridor development projects resulting from the Western Energy Corridor project. Under paragraphs 34.4(2)(b) and 35(2)(b) of the Fisheries Act, the Minister of Fisheries, Oceans and the Canadian Coast Guard (the Minister) may issue an authorization with terms and conditions in relation to a proposed work, undertaking or activity that may result in death of fish or harmful alteration, disruption or destruction of fish habitat. Factors that the Minister must consider prior to recommending to the Governor-in-Council regulations or the Minister exercising powers related to authorizations, permits, orders or Ministerial regulations include: (a) the contribution to the productivity of relevant fisheries; (b) fisheries management objectives; (c) whether there are measures and standards; (d) the cumulative effects; (e) any fish habitat banks; (f) whether any measures and standards to offset the harmful alteration, disruption or destruction of fish habitat give priority to the restoration of degraded fish habitat; (g) Indigenous knowledge of the Indigenous peoples of Canada that has been provided to the Minister; and (h) any other factor that the Minister considers relevant.  DFO could support a Regional Strategic Environmental Assessment to ...

  • September 29, 2022 BY EMAIL Impact Assessment Agency of Canada 160 Elgin St, 22nd Floor Ottawa, ON K1A 0H3 Attention: Colter Kelly Dear Colter Kelly, RE: Potential Regional Assessment of a Western Energy Corridor I am writing in response to your email request, dated September 8, 2022, for information to inform the response of the Minister of Environment and Climate Change (“Minister”) to Western Energy Corridor Inc’s (“Proponent”) request for a regional assessment for its proposed Western Energy Corridor (“Proposed Corridor”). Tataskweyak Cree Nation (“TCN”) appreciates the Proponent’s desire to conduct a regional assessment to, among other things, better understand the potential impacts of the Project on the rights and interests of Indigenous peoples. However, we are concerned that the route for the Proposed Corridor was chosen without any consultation with our community, especially since the Proposed Corridor would run through a substantial portion of TCN’s lands, including the northern portion of our Resource Management Area (“RMA”). Our 1992 agreement with Manitoba, Manitoba Hydro, and Canada, created the Resource Management Area Board (“RMAB”) and recognized TCN’s authority to be involved in deciding how lands within our RMA will be used. Accordingly, the Minister must not approve the request for a regional assessment unless and until the Proponent has consulted with our community and our RMAB about its proposed route through our lands. As it currently stands, TCN is opposed to the Proposed Corridor and the Proponent’s request for the regional assessment. I have included some information below, but please let me know if there are more specific questions. Manitoba would be happy to hear the results of IAAC’s analysis. Best, Laura Laura Pyles Manager, Policy, Strategic Initiatives and Engagement Environmental Approvals Branch Developments: We don’t have any projects coming forward that would be of this size. However, Manitoba is prioritizing resource development and investment, particularly mining. We are seeking to make the province more competitive by expediting environmental approvals, while protecting the environment. There are a number of mining sites that may be near the proposal depending on the path, including at Snow Lake. Protected Spaces: Manitoba has protected and conserved areas, in addition to sensitive areas for wildlife. We have not undertaken a full inventory of what sensitive areas may be as it is project- dependent on whether habitat would be disturbed. There are currently issues with moose conservation broadly in the province.
