On behalf of Mi’gmawe’l Tplu’taqnn, we are responding to the Draft Environmental Assessment Report for the above project, dated September 2020. Mi’gmawe’l Tplu’taqnn’s primary concern remains how the project impacts migratory species that are of great cultural significance to the Mi’gmaq, including salmon, swordfish, Bluefin tuna, Atlantic right whales, and migratory birds. Please find enclosed a report from Shared Value Solutions that we are submitting on behalf of Mi’gmawe’l Tplu’taqnn Incorporated. Based on the report, we highlight the following recommendations in particular: 1) The Agency and/or the Proponents should engage MTI and Anqotum Fisheries Resource Centre in designing and conducting a focused Atlantic Salmon research project that seeks to fill data gaps related to Atlantic Salmon use and existence in the Project Area. This should happen before any project approvals and will require dedicated proponent funding. 2) Establish a forum and process where Mi’gmawe’l Tplu’taqnn can meet with BHP whereby issues and follow-up program decision making regarding the Project can be brought forward, discussed, and addressed throughout the life of the Project. 3) The Proponents and the Crown must engage in direct, meaningful consultation with all Mi’gmaq First Nations of New Brunswick to ensure that its legitimate ...

Our first comment of concern, is on the follow-up and monitoring programs associated with the three projects. One of our repeated comments, notably expressed from past information requests on BHP Canada and West Flemish Pass Environmental Impact Statements, emphasize that the data collected from mitigation measures, follow-up and monitoring programs is not being integrated back into Strategic and Regional assessments. Extensive publication requirement for reports and summaries are included in the Draft Potential Conditions, but the level of details required in these reports is lacking, and there is still no mechanism for these results to be integrated into future processes. Data generated through project-specific environmental assessments should be made available in a format that allows it to be analysed, compiled and re-used for subsequent project-specific assessments, regional assessments or strategic assessments.   • Good morning,   I am responding in regards to the three projects and wanted to provide comments on each of the Draft EA Report and EA Conditions once I completed reviewing each.  As I just completed the review of the Central Ridge EA Report and EA Conditions I have the following comment on each of the reports and conditions    BHP Canada Draft EA Report and Potential EA Conditions Central Ridge Draft EA Report and Potential EA Conditions West Flemish Pass Draft EA Report and Potential EA Conditions   Each of the Draft EA Reports and EA Conditions, as I reviewed and please note I am not an expert in this field but from reviewing and getting clarification on some wording used within these reports, I did have a few questions but as I reviewed the material, I feel my questions were answered.    I believe each of the 3 projects provided a well written and detailed explanation of each section that was discussed.   As for the Indigenous material covered and information provided in response to some Indigenous First Nations questions, I found the answers provided was very informative and covered majority of the material I was wondering about,  to be specific, the Atlantic Salmon.   The only concern I had, which I had mentioned, was the migration patterns and noise factors with these projects.  The long term effects of these two areas does provide some concern, but like I ...

  • Bonjour,  Je vous écris car je pense qu'en 2020, il est bien trop tard pour investir dans le pétrole. Par respect pour les générations futures qui ne l'auront vraiment pas facile, et par respect pour la faune et la flore aquatique marine dont la Terre a besoin pour maintenir son fragile équilibre, je vous prie de cesser ce projet de forage. Nous l'avons vu par le passé, et même tout récemment : le forage n'est pas sans répercussions négatives. Les accidents arrivent souvent. Nous ne pouvons nous permettrent de risquer notre faune et notre flore aquatique. C'est un risque que nous ne pouvons PAS prendre. Ce n'est pas un jeu, ni un petit pari, nous parlons d'une question de vie et d'avenir pour tous. Soyons un exemple mondial. Je vous prie d'agréer. Juliette Poncsak

Ceci est une courte réaction sur ces trois projets qui visent surtout à rappeler et synthétiser nos principaux commentaires déjà présentés dans tous nos mémoires déposés dans le cadre de ces consultations. Nous avons analysé les documents intitulés « EE provisoire » et « Conditions potentielles » des 3 projets d’exploration déposés par BHP, Central Ridge et Passe Flamande. Remarque. Nous comprenons mal les règles d’appellation des projets de forage qui tantôt utilisent un nom de lieu, comme « dans l’ouest de la passe Flamande », tantôt le nom de la compagnie promotrice du projet, comme BHP. Il aurait été beaucoup plus simple, du moins pour les organismes consultés, d’accorder un nom composé du nom du promoteur et du lieu du projet. Nous aurions dû faire ce commentaire plus tôt ! COMMENTAIRES ET CRITIQUES Nutashkuan a participé aux consultations et déposé plusieurs mémoires comportant certaines critiques, particulièrement sur la pauvreté des connaissances des écosystèmes marins y compris les écosystèmes benthiques. Ces critiques n’ont pratiquement pas été retenues. Les gouvernements du Canada et de Terre-Neuve-Labrador ne se sont pas engagés dans la voie d’améliorer leurs connaissances. Le seul effort a été celui de mettre au point un système d’information géographique (SIG) spécifique à cette vaste zone océanique ; décision que nous avons soutenu.   • BHP Canada Exploration Drilling Project Draft Potential Conditions   As worded, condition 3.8 regarding other effective area-based conservation measures (OECMs) does not accurately reflect the expert advice provided by Fisheries and Oceans Canada (DFO).   It is unclear why condition 3.8 is now linked to “the area surveyed pursuant to 3.6”, i.e. the pre-drilling coral and sponge survey.  It has been DFO’s recommendation that the terminology remain consistent with the Ministerial Regulation in the use of “activity area”.   In addition, the first bullet in Condition 3.8 should refer to the conservation objectives of the area rather than “Canada’s ability to meet conservation targets”, i.e.  the Proponent shall… identify and implement any additional measures necessary to mitigate the Designated Project’s effects on the conservation objectives of the area…”  Again, it has been DFO’s recommendation that the wording of the condition remain consistent with the Ministerial Regulation.   As previously noted, the Government adopted the Panel’s recommendation to continue with a risk-based approach to prohibiting or allowing industrial activities in OECMs.  Before any activity can occur in an OECM, the Minister of Fisheries, Oceans and the Canadian Coast Guard will need to be satisfied that any risks to the area’s conservation objectives have been effectively avoided or mitigated through legislation or ...

  • La nouvelle génération devra composer avec le risque omniprésent de marée noire, tout en sachant que l'équipement pour la contenir prendrait jusqu'à 30 jours pour s'y rendre depuis la Norvège. Sans flotte canadienne pour contenir rapidement la marée noire, ce projet est inacceptablement risqué. Souhaitons-nous vraiment faire les manchettes mondiales en tant que pays pollueur ET désorganisé? De plus, compte tenu du contexte pandémique actuel, il est désolant de voir cette tentative d'évaluation accélérée. J'enjoins le gouvernement à revoir son processus afin d'en garantir l'intégrité et ainsi éviter une révision ultérieure qui pourrait s'avérer coûteuse.

Il s'agit d'une procédure inexcusable et qui me fait perdre complètement foi en mon gouvernement, celle-ci étant auparavant très chancelante.  Dans un second temps, je tiens à dire que je suis entièrement et complètement contre ce projet de loi. Les évaluations environnementales sont nécessaires pour la préservation de notre environnement. Venant d'un pays comme le Canada, je trouve que ce projet de loi est impensable et révoltant! Mr. Trudeau, c'est très bas de votre part de profiter du moment de détresse de vos concitoyens pour enrichir votre parti et vos ti-amis pétroliers. Plus jamais le parti libéral n'aura mon appui. J'en fait le serment. Les rapports du GIEC démontre clairement qu'il faut agir pour contrer les changements climatiques; ce projet - et tous les autres - vont à l'encontre de vos engagements de Paris. Je vous assure que nous ne laisserons pas ces projets se réaliser et que nous ferons tout pour faire cesser cette fuite en avant.   • Hi Joe, As I mentioned in a previous email, we have reviewed the proponent’s responses and have no further information requests. We did want to provide one clarifying comment for your information: For IR-01, with respect to potential overlapping sound effects if there were to be 2 MODUs used for simultaneous drilling, we refer to page 35 of the EIS summary (paragraph 4), which provides a summary of the sound modelling completed for the project. The modelling indicates that the ranges to acoustic thresholds for all sound sources are distances that would fall within a 500 m radius of each MODU. As you know, the NL Offshore Drilling and Production regulations require a 500 m safety zone surrounding each MODU. Based on the results of the modeling, the required safety zones would mitigate the potential for overlapping sound effects if there were to be simultaneous drilling.   • Hi Joe,  We’ve reviewed the Proponent’s IR responses for the BHP Canada Exploration Drilling Project and offer the following comments for your review and consideration.  2.1.1 IR-01 – This comment has not been adequately addressed. Recommend that the Proponent describe worst-case scenario for simultaneous and batch drilling (e.g., proximity of wells, temporal overlap of project activities). DFO is not in agreement with the statement, “whether the second mobile offshore drilling unit (MODU) is on an adjacent BHP licence, or on the licence of another operator will not change the cumulative effects assessment.” Generally, one would expect greater potential for cumulative effects within an EL due to the confined spatial scale of activities. Revision is recommended to address the discrepancy in the statements, “the specific location of individual wellsites and the specific nature and duration of any individual drilling activity carried out as part of the Project cannot currently be defined” and “there is little or no potential for interaction between the environmental zones of influence of each individual and simultaneous drilling campaign, and thus, for resulting combined environmental effects upon any VC”. If it is anticipated that zones of influence will not overlap, justification must be provided. It is not clear how drill cuttings and noise from simultaneous and batch drilling could affect marine fish and fish habitat and marine mammals and sea turtles ...
