Mi’gmawe’l Tplu’taqnn’s primary concern remains how the projects impact migratory species that are of great cultural significance to the Mi’gmaq, including salmon, swordfish, Bluefin tuna, Atlantic right whales, and migratory birds. Please find enclosed a report from Shared Value Solutions that we are submitting on behalf of Mi’gmawe’l Tplu’taqnn. Based on the report, we highlight the following recommendations in particular: 1) A focused and integrated Indigenous Knowledge and Science Study with respect to potential interactions between the Project Area and including salmon, swordfish, Bluefin tuna, Atlantic right whales, and migratory birds. This should happen before any project approvals. This will require proponent funding. 2) Establish a forum and process where Mi’gmawe’l Tplu’taqnn can meet with CNOOC International whereby issues and follow-up program decision making regarding the Projects can be brought forward, discussed, and addressed throughout the life of the Projects. 3) The Proponents and the Crown must ...

I wish to provide you with our comments, concerns and recommendations. KMKNO has contracted AECOM to conduct a review of the draft EA report and potential conditions and we have submitted the report to the Impact Assessment Agency of Canada (IAA). The Mi’kmaq are the holders of constitutionally protected Aboriginal and treaty rights, which include the Aboriginal right to fish for food and the treaty right to fish for a moderate livelihood. Any impacts to fish and fish habitat are impacts to Mi’kmaq rights. Therefore, it is our expectation the Mi’kmaq will be compensated for any infringement on fishing rights. We wish to reiterate our concern that this exploration project, as well as the other concurrent offshore oil and gas developments in Newfoundland, may impact both Atlantic salmon and American eel. The timing and design of the project activities will be important to reduce potential impact to migrating fish as well as those overwintering. We have already provided CIAA with a copy of the UINR report on Atlantic salmon that indicates drilling activities between the months of January to August pose a greater impact Atlantic salmon in the area.   • October 18, 2019 RE: Request for Public Comments CNOOC International Flemish Pass Exploration Drilling Project To Whom It May Concern, The analysis conducted by the Impact Assessment Agency of Canada (the Agency) and its conclusions cannot be complete as they do not represent adequately the current use of resources and the applied values to international fisheries operations in the North Atlantic Fishing Organization (NAFO) regulatory area (NRA). I am a member of the international fishing industry originally from Newfoundland, my livelihood now depends on the fishery in the Flemish Pass basin. I have watched and felt the impact of O&G operations on the Newfoundland offshore. As stated in this draft EA the potential negative effects from an oil spill may be low for shoreline coastal communities. However, any oil spill, will be detrimental to our year-round fishing operations, which in turn corresponds to an extremely high socioeconomic importance for many non-Canadian communities. Our company fishes it´s allocated quotas as well as quotas from other contracting parties in the NRA. As well in the past we have fished in agreement, part of Canada´s quota outside the Canadian EEZ. The three oil spills that have occurred this year on the Newfoundland offshore shows that regulations for offshore O&G operations are outdated and do not reflect the needs of current and future potential expanding activities of the offshore oil and gas sector. The recent statement by the Newfoundland and Labrador minister of natural resources confirms that long suspicion.
