The National Energy Board has the duty to see that its public hearings are safe for the public, participants, NEB staff and the presiding members. In order to help fulfill this duty, open source information and social media scans are conducted and information is sought from local police, the RCMP and other organizations that may help to identify and evaluate risks. The position of, and the passion expressed by, a party is not a factor in determining whether a party poses a risk. Any threats of criminal action, disobedience or disturbance to the process, however, are taken seriously so that appropriate security measures can be put in place before incidents occur to ensure the safety of the public, participants, NEB staff and presiding members. Rallies and meetings planned near to, and to coincide with, our hearings are identified in this regard. Even when the organizers of these events are not a safety risk, the events themselves may attract individuals or groups who are. Events that are meant to be peaceful can turn violent despite the intentions of the organizers.   • Joint Review Panel Application for the Enbridge Northern Gateway Project NEB 444 Seventh Ave. SW Calgary, Alberta T2P 0X8 November 18, 2013 Dear Members of the Joint Review Panel: This letter is to express my objections to the way the JRP, through its lawyer handled my latest Notice of Motion #24. I posted it on November 13 on the IRP website. I had contacted - on November 4, asking if it was still possible to file a Notice of Motion after the proceedings were closed. She diligently communicated her findings on November 5 and gave me useful legal references for filing the motion. While it was easy to post it on November 13 on the JRP website, difficulties with my g-mail prevented me to send it to all intervenors as required. These difficulties arose about 6 months ago when some changes in the g-mail program nrevented me from copying the 232 e-mail addresses, something I was able to do before. , Regulatory Officer with the NEB, helped me many times and without any hesitation in the past, for doing such, so it was in good faith that I requested her to do so for #24 in an e-mail to her. I also left her a phone message. I was surprised to receive a phone call from on November 14, telling me she had been instructed by the lawyer to NOT forward the document on my behalf because the proceedings were closed and thati was on my own for sending the Notice’of Motion to all intervenors.. I phoned on November 15. She simply replied she could neither let me know if she had instructe4 or not to help me, nor comment on it, because it was client/lawyer privilege. I contend that to give instructions to help an intervenor trying to follow the requirements to perform her duties is nothing short of an obstruction. It is in sharp ...

  • Joint Review Panel Northern Gateway Project October 25, 2013 Dear Panel Members: I want to voice my displeasure at the poor way the amendment to the agreement between the NEB and the Minister of the Environment regarding the joint review of the northern gateway pipeline project was communicated to intervenors in the review and the pubic at large. I note Minister Aglukkaq signed the agreement September 21, Mr. Caron October 2 and it was posted on the website October 7. No notification of this amendment was sent to intervenors. I had to phone Mr. Hudson to find out what it was about which could have been easily explained in plain language. This silent posting does not inspire trust in the process which has already been plagued with significant changes along the way. I request that, if any changes to the process are forthcoming, that the Panel communicate those changes directly to intervenors using plain English language and the reasons for the changes. The new information consisted of bringing to the panels’ attention that each intervenor ahead of the participant had a veto whether a participant could move ahead and that with needing permission from multiple participants, Intervenors have to make exponential efforts to achieve fairness of participation. Maybe the realization that proceeding alphabetically places obstacles in the way of those later in the alphabet was apparent to the JRP when establishing that process and not new to them, but the components of the notice of motion were new information presented publically. Or the panel is simply not paying attention to information put before it. Far from being equitable and objective alphabetical ordering is biased and discriminatory as may be found from studies and research showing, among other things: • affects happiness • affects academic standing • confers political advantage • affects income earning to the measurable extent of 1% difference per letter in the alphabet - with those at the end of the alphabet, generally earning 25% less than those whose name starts at the beginning of the alphabet. If given a go-ahead, the pipeline project would: Fragment the boreal forest, home to birds and other wildlife, including Woodland Caribou and Grizzly Bears. Expose the Great Bear Rainforest, home to wolves and the iconic Spirit Bear, and 30 internationally recognized Important Bird Areas teeming with marine birds, fish and other animals to potential oil spills and pollution from increased tanker traffic. Risk irreversible harm to the livelihoods of many coastal and aboriginal communities. Moving that much oil that far is bound to have devastating effect on the environment. As a citizen of Canada I have grave concerns about the future health and welfare of our great country. Specifically, our environment is OBVIOUSLY facing grave danger in the not distant future from rampant development of the TAR sands (they maybe produce oil, but they consist of TAR SANDS) which entail horrific tailing ponds and huge use of the areas water supply. To put in a pipeline for the purpose of moving the product of the tar sands to the west coast is foolish (listen to the First Nations people it is their life and land that is being endangered). My interest stems from the fact that in my 70 years of living, I have witnessed tremendous changes in my environment. Some undoubtedly are due to overpopulation but by far, the most are directly attributable to 20 and 21st century technology, primarily the combustible gasoline engine. As for the pipeline, time and time again we have seen the results of pipeline breakdowns, explosions, leaks, etc. You can never completely reverse the results of these accidents.
