Notice of Determination for the One Arrow Subdivision

 

July 24, 2026 - Indigenous Services Canada has determined that the proposed One Arrow Subdivision is not likely to cause significant adverse environmental effects.

 

The determination was based on a consideration of the following factors: 

- the One Arrow First Nation have authorized the project by Band Council Resolution, and their membership will benefit from the project

- no comments were received from the public about the project

- mitigation measures are required for the project

 

Implementation of the following mitigation measures is required for the project: 

  1. The project shall proceed in the manner described in the ISC Project Description form (June 10, 2026), Simple Environmental Review Report (BCL Engineering Ltd., dated July 16, 2026) and other supporting documents. The Proponent will immediately notify ISC of any changes to the proposed project for approval.
  2. Relevant permits and approvals will be obtained before undertaking any work. It is the Proponent's responsibility to meet all applicable federal, provincial and municipal laws and regulations that apply to the proposed project. This Notice of Determination does not apply to ancillary features associated with this development that were not included in the Project Description form.
  3. All work will be carried out in accordance with the Migratory Bird Convention Act and applicable regulations.
    • If any grubbing or topsoil stripping occurs with the nesting period of the region (late April – late August), the site will be inspected prior to determine the presence of any nesting birds.
    • The inspection will occur within 7 days of the start of construction activities and will consist of a visual and auditory inspection by a qualified professional to assess breeding activity within and surrounding the project area.
    • The inspection will be conducted by walking transects with intermittent stopping points to record all birds that are seen or heard, while also noting observed breeding behaviors.
    • If a bird is accidentally flushed, the immediate area will be vacated promptly.
    • Suspected nesting locations will be recorded, and appropriate buffer zones/mitigation measures will be established.
    • ISC and Environment and Climate Change Canada must also be contacted immediately to determine mitigation strategies.
  4. Equipment shall arrive onsite clean and in good condition and materials imported to site will be inspected prior to placement to confirm absence of any potential contaminants.
    • Equipment idling will be kept to a minimum throughout the duration of construction.
  5. No staging, storage areas or spoil piles areas will be located within 30 m of a wetland boundary. Material is not to be stored withing treed areas.
  6. Construction activities will only occur during daytime hours, and combined equipment noise levels will not exceed 80 decibels.
  7. Topsoil and subsoil will be salvaged and store unmixed, until they are reused for final landscaping or elsewhere as needed on the First Nation land.
    • Soil stabilization, erosion and sedimentation controls measures will be implemented early during the construction phase following initial ground disturbance to prevent soil erosion.
    • During construction, inspect, repair, and maintain erosion and sedimentation control measures until permanent vegetation has been established.
    • After construction, remove erosion and sedimentation controls and restore and stabilize areas disturbed during removal.
    • Post construction, disturbed areas will be stabilized and revegetated.
  8. Maintain natural drainage pathways where possible during clean-up and reclamation activities.
  9. All waste materials will be disposed of an approved waste management facility and in accordance with provincial and municipal legislation.
  10. The contractor will have an emergency response plan and spill kits to manage fuel spills. Regardless of volume, any spilled substance that may cause an adverse effect must be cleaned up immediately and removed from the site for proper disposal.
  11. All spills must be reported to relevant federal, provincial and municipal government departments.

 

Indigenous Services Canada (ISC) is satisfied that the carrying out of the project, with mitigation measures, is not likely to cause significant adverse environmental effects.
