Notice of Determination

North Vancouver, B.C. – March 31, 2026 – The Vancouver Fraser Port Authority has determined that the proposed Passenger dock replacement located on the east bank at the head of Indian Arm, North Vancouver, BC is not likely to cause significant adverse environmental effects

The determination was based on a consideration of the following factors:

  • Impacts on rights of Indigenous peoples
  • Indigenous knowledge
  • Technically and economically feasible mitigation measures

Best efforts were made to consult with the Musqueam Indian Band; S'ólh Téméxw Stewardship Alliance, including Aitchelitz First Nation, Chawathil First Nation, Cheam First Nation, Kwaw'Kwaw'Apilt First Nation, Scowlitz First Nation, Seabird Island Band, Shxwha:y Village, Shxw'ow'hamel First Nation, Skawahlook First Nation, Skwah First Nation, Skowkale First Nation, Soowahlie First Nation, Squiala First Nation, Sumas First Nation, Tzeachten First Nation, Yakweakwioose First Nation, and Yale First Nation; Snuneymuxw First Nation; Squamish Nation; and Tsleil-Waututh Nation. Comments raised included:

  • Request for copies of environmental monitoring reports and to be notified in the event of an environmental spill.

The project was posted to the Canadian Impact Assessment Registry on January 13, 2026 for public comment. No comment was received.

Mitigation measures and/or permit conditions taken into account in making the determination include:

  • The Permit Holder shall carry out the Project in accordance with the approved project drawings and supporting technical documents, including all mitigation measures identified therein, to the satisfaction of the Port Authority
  • The Permit Holder shall ensure that all works remain outside the VFPA habitat restoration/offsetting area, and that no equipment, materials, or vessels encroach into the offsetting footprint
  • The Permit Holder shall ensure that all marine access and vessel transit routes avoid the habitat restoration/offsetting area, consistent with the confirmed marine access plan
  • As works are anticipated to occur outside the fisheries timing window, the Permit Holder shall implement additional mitigation measures during installation of offshore anchoring components, including slow and controlled placement of anchors to minimize disturbance to fish and fish habitat
  • The Permit Holder shall ensure that a qualified environmental monitor is present during in-water works to observe for fish presence (e.g., schooling fish such as herring), and shall temporarily pause works if fish are observed in close proximity to the work area
  • The Permit Holder shall implement spill prevention, containment, and response measures, and ensure that appropriate spill response materials are available on site at all times
  • The Permit Holder shall ensure that no debris, waste materials, or deleterious substances enter the marine environment, and that all materials are properly managed and disposed of at approved upland facilities
  • The permit holder shall provide environmental monitoring reports to the port authority's satisfaction
  • The permit holder shall immediately cease work and notify the port authority if the permit holder has reasonable grounds to believe that the project has harmed fish of fish habitat

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.
