Notice of Determination

Delta, B.C. – June 17, 2025 – The Vancouver Fraser Port Authority has determined that the proposed Pile Installation – Ruskin Construction, located at 8031 River Road, Delta, BC is not likely to cause significant adverse environmental effects.

The determination was based on a consideration of the following factors:

  • Impacts on rights of Indigenous peoples
  • Indigenous knowledge
  • Community knowledge
  • Comments received from the public
  • Technically and economically feasible mitigation measures

Best efforts were made to consult with Cowichan Tribes, Halalt First Nation, Katzie First Nation, Kwantlen First Nation, Penelakut Tribe, Lyackson First Nation, Musqueam Indian Band, Semiahoo First Nation, S'ólhTéméxw Stewardship Alliance, Stz'uminus First Nation, Tsawwassen First Nation, Tsleil-Waututh Nation, and Ts'uubaa-asatx. Comments were related to spills, marine mammal observation, and underwater noise.

The project was posted to the Canadian Impact Assessment Registry on April 11, 2025 for public comment. No comments were received.

Council of Marine Carriers were notified and, in response, indicated that they had no concerns.

Mitigation measures and/or permit conditions taken into account in making the determination include:

  • All works will be carried out in accordance with the Construction Environmental Management Plan
  • There will be no in-water works during the fisheries sensitive period from March 1 to June 15, inclusive
  • A spill prevention, containment and clean-up plan will be developed for the project, be available in the immediate working area, and project personnel will be trained on spill prevention, containment, and clean-up
  • Visual marine mammal monitoring will be carried prior to and during construction

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.
