Notice of Determination

Tsawout FN Main Village – [August 26, 2025] – Indigenous Services Canada has determined that the proposed Tsawout First Nation Access Road is not likely to result in significant adverse effects. The Project was posted to the Canadian Impact Assessment Registry on May 30th 2025, for public comment. No comments were received.

This determination was based on a consideration of the following factors:

· Environmental Impact Assessment

· Indigenous knowledge;

· community knowledge;

· comments received from the public; and

· technically and economically feasible mitigation measures.

Mitigation measures taken into account for this determination are:

  • Installation of silt fencing to protect waterbodies from runoff
  • Emergency spill plan
  • Invasive species management procedures
  • Clearing and grubbing during winter months, outside the bird nesting period, to protect migratory birds and their nests.

The authorities are satisfied that the carrying out of the Project is not likely to cause significant adverse environmental effects if all mitigation measures are applied.

Therefore, Indigenous Services Canada and Environment and Climate Change Canada may exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
