Notice of Determination

Burnaby, B.C. – February 9, 2024 - The Vancouver Fraser Port Authority has determined that the proposed Berry Point TCZ-2 and TCZ-3 Range Light Installations located approximately 100 metres off the coast of the Burnaby Refinery at Berry Point, in Burnaby is not likely to cause significant adverse environmental effects.

The determination was based on a consideration of the following factors:

  • Impacts on rights of Indigenous peoples
  • Indigenous knowledge
  • Community knowledge
  • Comments received from the public
  • Technically and economically feasible mitigation measures

Best efforts were made to consult with Musqueam Indian Band, Squamish Nation, S'ólh Téméxw Stewardship Alliance, and Tsleil-Waututh Nation. One comment was raised, which focused on DFO's letter of advice for the project. DFO's recommendations for this project will be included in the construction environmental management plan.

The project was posted to the Canadian Impact Assessment Registry on November 21, 2023, for public comment. One comment was received from Trans Mountain highlighting their support for the project.

The City of Burnaby, Parkland Refining Ltd., the Council of Marine Carriers, the Canadian Coast Guard, the Pacific Pilotage Authority, and the British Columbia Coast Pilots were notified. The following concerns and comments raised were:

  • Impact of construction activities including traffic and potential ground vibrations from construction
  • The length of the public engagement period was too short
  • Request for 100% complete drawings and the inclusion of a fall protection system
  • Operation times of the sector light

Mitigation measures taken into account in making the determination include:

  • The works will not deposit a deleterious substance in water inhabited by fish or affect fish or fish habitat in a manner contrary to the Fisheries Act
  • The Project will be carried out in accordance with a construction environmental management plan
  • Piles will be installed using a vibratory or drop hammer, drilling may be required
  • Barges and other support vessels will be prevented from grounding on the foreshore, seabed or otherwise disturb the foreshore or seabed
  • There will be no in-water works during the fisheries-sensitive period from March 1 to August 15, inclusive
  • All activities involving the use of concrete, cement, or other lime-containing construction materials will be conducted so that the materials do not enter the aquatic environment
  • Issued For Construction drawings will be required before commencing any physical or construction activities

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.
