Notice of Determination

Port Dover, Ontario – May 4, 2020 – The Department of Fisheries and Oceans, Real Property Ontario and Prairie Region, Engineering and Technical Support has determined that the proposed Port Dover Search and Rescue Station Floating Dock Repairs Project is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

  • impacts on rights of Indigenous peoples;
  • Indigenous knowledge;
  • community knowledge;
  • comments received from the public;
  • letter of advice received from the Fish and Fish Habitat Protection Program; and
  • technically and economically feasible mitigation measures.


Mitigation measures taken into account for this determination are:

  • In-water works, undertakings, and activities will respect timing windows to protect fish, including their eggs, juveniles, spawning adults, and/or the organisms upon which they feed and migrate.
    • No in-water work will occur between April 1st and July 15th
  • Limit the duration of in-water works, undertakings, and activities so that it does not diminish the ability of fish to carry out one or more of their life processes (spawning, rearing, feeding, migrating).
    • In water undertakings and activities will be conducted during periods of low water levels.
  • An erosion and sediment control plan will be developed and implemented to minimize the introduction of sediment into any waterbody during all phases of the work, undertaking, or activity;
    • Effective erosion and sediment control measures will be installed prior to beginning the work, undertaking, or activity in order to stabilize all erodible and exposed areas.
    • Work will be scheduled to avoid wet, windy, and rainy periods that may result in high flow volumes and/or increase erosion and sedimentation. Weather advisories will be heeded) that
    • Machinery will be operated on land in stable dry areas.
  • A response plan will be developed and implemented to avoid a spill of deleterious substances.
    • Activities near water will be planned such that materials such as paint, primers, blasting abrasives, rust solvents, degreasers, grout, poured concrete, or other chemicals will not enter the watercourse.

The Department of Fisheries and Oceans, Real Property Ontario and Prairie Region, Engineering and Technical Support is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.


Therefore, the Department of Fisheries and Oceans, Real Property Ontario and Prairie Region may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
