Notice of Determination

Burnaby, B.C. –January 12, 2021 – The Vancouver Fraser Port Authority has determined that the proposed Shellburn Berthing Dolphin Replacement Project – Amendment PER No. 20-012-01 (Condition 23 - Extended Hours) located at 201 Kensington Ave., Burnaby, B.C., not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

  • Impacts on rights of Indigenous peoples
  • Indigenous knowledge
  • Community knowledge
  • Comments received from the public
  • Technically and economically feasible mitigation measures

Mitigation measures taken into account for this determination are:

  • Works to be conducted outside regular hours are limited to activities that are not anticipated to generate significant noise
  • The Permit Holder is committed to concentrating any activities likely to generate noise to daytime hours, minimizing potential disturbances on surrounding residents, and addressing complaints promptly should they arise
  • Lights shall be directed down and away from residential areas and welding shields shall be used
  • Mitigations implemented during daytime hours will be implemented during extended work hours

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, the Vancouver Fraser Port Authority may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
