Project:

Xplornet Telecommunications Inc. is proposing the construction and operation of a 29.9 metres tall telecommunications tower to replace the existing tower, located in Alberta Beach, Alberta and approximately 110 metres southeast of Lac Ste. Anne. As proposed, the Xplornet Telecommunications Tower Project would occupy an area of 20.35 square metres of previously disturbed land.

Decision:

Non-designated project

Reasons:

The Minister of Environment and Climate Change has considered the potential for the Project to cause adverse effects within federal jurisdiction, adverse direct or incidental effects, public concern related to these effects, as well as adverse impacts on the Aboriginal and treaty rights of the Indigenous Peoples of Canada. The Minister also considered the analysis of the Impact Assessment Agency of Canada.

The Minister has reached the decision that the designation of the Project is unwarranted for the following reasons:

  • the potential for adverse aforementioned effects are not expected (no adverse direct or incidental effects are anticipated as no federal authority is expected to render a decision that would enable the Project to be carried out); and
  • the Project must comply with relevant provisions of federal legislation, including the Fisheries Act, the Migratory Birds Convention Act, 1994 and the Radiocommunication Act.
