Resource Document for Comments on Milton Logistics Hub Project Draft Agreement to Establish a Review Panel and Terms of Reference

The Canadian Environmental Assessment Agency and the Canadian Transportation Agency invite the public to comment on the draft Agreement to Establish a Review Panel and Terms of Reference (the draft Agreement) for the Milton Logistics Hub project in Milton, Ontario. Once final, the Agreement and Terms of Reference will establish the mandate and authority of the review panel, as well as the procedures and timelines for the conduct of the review. The public, Indigenous groups, governments and other interested parties are invited to submit written comments on the draft Agreement in either official language by July 11, 2016.

Purpose of this resource document

This resource document provides a template (see links below) to assist participants in the environmental assessment to undertake their own review of the draft Agreement and to prepare comments they wish to submit for consideration in the finalization of the documents. Use of the template is not mandatory.

Guiding questions for the review

Comments on the draft Agreement should address the terms of the agreement, panel mandate, factors to be considered, processes and timelines. Participants are encouraged to provide comments and rationale to support any suggested changes. Any comments received will be made public and posted on the online public registry.

When reviewing the draft Agreement, the following questions can be used as a guide:

  • Does the process set out in the draft Agreement (specifically the draft Terms of Reference) have any gaps that would prevent a fair opportunity for all parties to have their views considered in the review?
  • Is clarity required to understand the process for the establishment of the review panel, its mandate, the factors to be considered in the review, or the processes and timelines for the review?

At this time, the Agency is NOT seeking a review of technical aspects of the proponent's information, whether the information is correct or whether or not participants agree with the conclusions of proponent. These matters will be discussed after the Review Panel is appointed.

Examples of comments that would be more appropriate for later in the process:

  • Opinions regarding the proponent's conclusions on the significance of the Project's effects on a species, based on the information provided;
  • Recommendations that the proponent use a different model to predict the potential effects of the Project.

How to complete the comment template:

Use the headings provided in the table, and to the best of your ability, identify:

  • the section of the draft Agreement or Terms of Reference where the information is or should be;
  • what changes you feel are necessary to the documents; and
  • a rationale as to why information should be present.
