RE: Roberts Bank Terminal 2 Project
Review PanelTerms of Reference and Updated Guidelines for the
Preparation of an Environmental Impact Statement.

On April17, 2015, the Minister of the Environment, the Honourable Leona Aglukkaq, issued the Review PanelTerms of Reference for the Roberts Bank Terminal 2 Project. At the same time, the Minister set the scope of the factors to be taken into account in the environmental assessment. The factors are reflected in the updated Guidelines for the Preparation of an Environmental Impact Statement. Both documents are attached for your convenience.

As reflected in the Terms of Reference, and pursuant to paragraph 19(1)(J) of the Canadian Environmental Assessment Act 2012 (CEAA 2012), the Minister has identified two additional matters relevant to the environmentalassessment that must be taken into account. These matters are:

  1. Marine Shipping:
    The environmental effects of marine shipping associated with the Project which is beyond the care and controlof the proponent and extending to the 12 nautical mile limit of Canada's territorial sea ("marine shipping associated with the Project"), including the environmental effects of malfunctions or accidents and any cumulative environmental effects, the significance of those effects, suggested mitigation measures and the possible requirements of any follow-up program that may be required; and,
  2. Provincial Socioeconomic Assessment:
    The potential economic, social, heritage and health effects of the Project, including cumulative effects, which may not be encompassed by the definition of environmental effects under the CEAA 2012, and practicable means to mitigate such potential adverse effects.

The requirements outlining the minimum information related to marine shipping that Port Metro Vancouver must provide are set out in section 17 of the Guidelines. The information requirements related to the potential economic, social, heritage and health effects of the Project and under the umbrella of provincial socioeconomic assessment are outlined in section 18 of the Guidelines.

To facilitate planning by the Agency and the participants in the environmental assessment, please provide an estimated schedule for the provision of the Environmental Impact Statement and the information required for the two additional matters. We would appreciate receiving the schedule before April 20, 2015.
