Decision

Fisheries and Oceans Canada has taken the following course of action on June 27, 2014 relating to the comprehensive study of the Keeyask Generation Project – CEAR # 64144. Fisheries and Oceans Canada may exercise any power or perform any duty or function with respect to the project because, after taking into consideration the comprehensive study report and taking into account the implementation of appropriate mitigation measures, Fisheries and Oceans Canada is of the opinion that the project is not likely to cause significant environmental effects.

Implementation of mitigation measures is required for the project to address:

Biological

  • birds and/or their habitat
  • fauna at risk (as defined under the Species at Risk Act)
  • fish and/or their habitat
  • mammals and/or their habitat

Human (effect of any change in the environment on ...)

  • current use of land and resources for traditional purposes by aboriginal persons
  • human health and safety
  • physical and/or cultural heritage
  • socio-economic impacts
  • structure, site or thing of historic, archaeological, paleontological or architectural significance

Physical

  • air quality
  • noise levels
  • sedimentation
  • soil quality
  • surface and bedrock features
  • vegetation
  • water quality
  • water quantity

A follow-up program to verify the accuracy of the environmental assessment and/or determine the effectiveness of any measures taken to mitigate the adverse environmental effects is required for this project. The follow-up program will be comprised of Proponent obligations for monitoring and reporting as identified in their Aquatic Effects Monitoring Program, as well as monitoring and reporting requirements contained in applicable federal and provincial permits.
